Terms of Service - Custom Domain Program

Please read the following Terms & Conditions carefully. You acknowledge that your use of this website is an indication of your acceptance of these Custom Domain Terms & Conditions and our regular Terms and Conditions.

Introduction

1.1. This page sets out the terms and conditions that apply to the Mixo Custom Domain Program (the "Custom Domain Program"). 1.2. Under this program, you may purchase a custom domain through our third-party partnership with Namecheap.com. 1.3. By creating an account with Mixo you accept these terms, along with our Mixo Terms and Conditions and all other relevant terms and conditions. Do not participate in the Custom Domain Program if you do not wish to be bound by these terms.

Domain Policy

2.1. Users are allowed to get one custom domain name for each active website subscription. Customers have the option to register the custom domain under their personal name. Otherwise, Mixo owns and maintains complete ownership and control over all domains purchased by the company. 2.2. During the domain registration process, customers can provide their registrant details, including their name, contact information, and any other required details for domain registration. It is the customer's responsibility to ensure the accuracy and legitimacy of the information provided during the registration process. 2.3. By registering the domain under their name, customers acknowledge that they assume full responsibility for the domain, including but not limited to renewal, compliance with legal and ethical guidelines, and any disputes that may arise. Mixo reserves the right to verify the accuracy of the registrant information provided by the customer. 2.4. In the event of a transfer of ownership, customers must follow the procedures outlined in this policy, and the new registrant must comply with the terms and conditions set forth herein. 2.5. Mixo does not offer refunds for the domain purchase. 2.6. Mixo reserves the right to suspend or terminate the domain registration service if the user violates any of the terms and conditions set forth in this policy. 2.7. Mixo may suspend or terminate the domain registration service if the user fails to pay the required fees or charges associated with the domain registration service. 2.8. Any damages or losses incurred as a result of the user's violation of the terms and conditions set forth in this policy will be the responsibility of the user. 2.9. All domains purchased through the Mixo Custom Domain Program will reside under Mixo's Namecheap account. Users will not have direct access to the domain registrar account. 2.10. Mixo will manage the domain registration, renewal, and any other domain-related services on behalf of the user.

Ownership and Transfer

3.1. When the domain is owned by Mixo, in order to transfer ownership of the domain name or delete it, users must have an active subscription for at least three (3) consecutive months. 3.2. In order to transfer ownership of a discounted or free domain, users must have an associated active site subscription for at least three (3) consecutive months. If the user cancels their subscription before the three-month period, the user will be required to pay the full price of the domain before the transfer can be completed. 3.3. The transfer of domain name ownership needs a processing period of 60 to 70 days. 3.4. Users are not allowed to resell or transfer the ownership of the domain name to a third party without prior consent from the company. 3.5. As part of the transfer of ownership, the user may be asked to provide a valid NameCheap user to transfer the domain access to. Failure to provide a valid NameCheap user may result in the inability to transfer the domain.

Domain Name Selection

4.1. Users are advised to choose a unique and appropriate domain name that complies with legal and ethical guidelines. 4.2. Any disputes or issues related to domain ownership will be resolved in accordance with the terms and conditions set forth in this policy. 4.3. Mixo reserves the right to reject any domain name that is deemed inappropriate, offensive, or violates any legal or ethical guidelines. 4.4. Mixo may not be held responsible for any disputes or issues arising from the domain name selection or registration process. 4.5. Mixo does not guarantee the availability of any specific domain name, and the user acknowledges that the domain name may be subject to availability and registration restrictions. 4.6. Certain TLDs (Top-Level Domains) may have additional restrictions or requirements for registration. Users are advised to review the registration requirements for the desired TLD before proceeding with the domain registration process.

Modifications and Updates

5.1. The company reserves the right to modify or update this policy at any time without prior notice.

Limitation of Liability and Indemnification

6.1. The company is not liable for any direct, indirect, incidental, or consequential damages that may arise from the use or inability to use the domain services. 6.2. Users agree to indemnify and hold the company, its affiliates, officers, agents, and employees harmless from any claims, damages, or losses that arise from their use of the domain.

Termination Clause

7.1. Mixo reserves the right to terminate the domain service for breaches of agreement, illegal activity, or misuse of the domain.

Force Majeure

8.1. Mixo is not liable for non-performance or delays due to events beyond its control, such as natural disasters, government actions, or technical failures.

By agreeing to register a custom domain name, the user agrees to abide by the terms and conditions set forth in this policy.
